Terms and Conditions

1. These Terms & Conditions should be read in conjunction with the ‘pre departure information’ and ‘overview’ sections of the website which contain more detailed information about trip inclusions, costs and visas etc. We advise you strongly to read all of the information contained on the website before sending in your deposit. However, you may cancel your booking within 14 days of us receiving your deposit without penalty, if after reading these documents you feel you have misunderstood any of this information.

2. We reserve the right to decline any booking at our discretion.

3. A booking is made in the name of the client and is not transferable to another person.

4. To make a booking you must completed and sign a booking form and send it to us a with a non-refundable £200 deposit. The remainder of the cost must be paid not less than 12 weeks prior to the expedition departure date. If you book less than 12 weeks before departure, full payment must be made on booking (this does not include the local payment.)

5. Endeavour overland guarantees not to increase the trip price once the deposit has been received.

6. The local payment must be made to the expedition leader on the morning of the first day of the expedition at the pre departure meeting.

7. Should you wish to cancel your trip, you must notify us in writing as soon as possible.

8. If you cancel your booking more than 12 weeks prior to departure we will not refund your deposit but we will refund the balance of the expedition cost if you have paid in full.

9. If you cancel your booking less than 12 weeks prior to departure we will not refund any monies paid. The client acknowledges that payment for the trip is an intrinsic part of the trips income and contributes towards the overall costs of equipment, vehicle running costs, vehicle insurance, staff administration, visa and all visa related costs, pre booking of trip related hotels, guides and permits etc and will have incurred a large part of its costs before the actual departure date.

10. In the unlikely event that we are forced to cancel the expedition prior to departure due to the fact that we have not reached the minimum number of clients required to run the trip we will offer you a full refund of all monies paid or offer you a alternative trip of comparable standard from us, if available. This will be the full extent of our liability. In the event of a cancellation, Endeavour Overland is not responsible for reimbursing any other costs including, but not limited to, equipment, flights, vaccinations and medication purchased by the client.

11. If the client has any medical problem or disability, you are required to inform us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements, health and safety considerations and what, if any, reasonable adjustments are required to be made. In any event, you must give us full details in writing at the time of booking. If any medical problems or disabilities are suffered or arise between the medical declaration being submitted and the Departure Date you must notify us immediately. We reserve the right to decline or cancel a booking without having to pay any compensation.

12. We may require the client to obtain confirmation from a medical professional that you are fit to travel. If we reasonably believe that you/the client is not sufficiently fit to take part in the Trip we may decline or cancel the booking at any time at our complete discretion.

13. Force Majeure – This means that we will not pay you compensation if we have to cancel or change your trip in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, epidemics or health risks, closed or congested airports, ports or stations, poor local infrastructure, changes imposed by rescheduling or cancellation of transport by the transport supplier such as flights by airlines or main charterer, the alteration of transport or transport types, adverse weather conditions (actual or threatened), avalanche and technical failure with transport, Foreign and Commonwealth Office advice changing and advising against travel to the trip destination.

14. The itineraries and other details are published in good faith as statements of intention only and reasonable changes to the itinerary, vehicle and equipment use, etc. may be made where we deem necessary and may change at any time at the discretion of the expedition leader.

15. Endeavour overland reserves the right to deviate from the advertised expedition route if in their reasonable opinion such deviation is necessary for the safety or wellbeing of any or any one of the members of the expedition or for the satisfactory progress of the expedition. In the event of it becoming necessary to fly over a country or countries in order to satisfactorily and safely continue the expedition, all costs of client’s flights will be borne by the client. Please check to see if your insurance will cover this.

16. We strongly recommend obtaining insurance at the time of booking in order to cover you for losses should you/we have to cancel your trip. We cannot refund your deposit or subsequent payments once the cancellation deadlines have passed.

17. Should you choose to leave during the expedition at any time you will not receive any refund of expedition payment or local payment, nor have any claim against Endeavour Overland in respect of any further expenses.

18. As a member of the expedition you agree to comply with the laws and regulations, whether in respect of health, immigration, currency exchange control or any other matter of all the countries visited during the expedition.

19. If the expedition leader considers the actions or conduct of any client is likely to prejudice the safety or wellbeing of all or any members of the trip or satisfactory progress of the trip then he/she shall be entitled to order the client to leave the trip immediately with no refund of the trip price or local payment and all liability and responsibility that Endeavour overland may bear to the client will immediately cease, including any provision for alternative transport. The decision of the expedition leader will be final on all matters relating to the satisfactory progress, organization and wellbeing of the expedition. Clients must comply with all reasonable requests of the tour leader. If, in the opinion of Endeavour overland expedition leaders or directors, the health or conduct of a client at any time before or after departure appears likely to endanger the safe, comfortable or happy progress of a trip, the client may be excluded from all or part of the trip without refund or recompense.

20. If a client commits an illegal act the client may be excluded from the trip and Endeavour overland shall cease to have responsibility to/for them. No refund will be given for any unused services.

21. The client accepts that owing to the nature of countries visited, all expeditions involve an element of personal risk and are of a potentially hazardous and unpredictable nature. In many countries visited the basic infrastructure, such as roads, is very poor and therefore less safe than those familiar to people from many western countries. In particular, lack of road markings or warning signs, unmarked speed bumps, seasonal flooding of roads and bridges, local vehicles which are poorly maintained and driven and which are hazardous to other road users etc. are factors beyond the control of Endeavour Overland.

22. The client accepts that in some areas we drive ‘off road’ and that this involves personal risk when the expedition vehicle can be negotiating rough terrain. Endeavour overland owns and operates its own expedition vehicles and employs its own crew. Do not book on this expedition unless you accept this element of risk.

23. Clients accept that any personal possessions such as valuables, cameras or any monies that are (a) carried on Endeavour Overland’s own vehicles (b) carried on any forms of public transport or transport supplied by independent sub-contractors (c) left in accommodation provided by Endeavour Overland or its suppliers during a trip or (d) left in the care of Endeavour Overland or its suppliers whilst on an activity, are carried and left in storage at the client’s own risk. Endeavour Overland does not accept responsibility for clients’ personal possessions or valuables that are lost, stolen or damaged during the course of a trip.

24. Insurance - All participants must be covered by personal travel insurance. This must cover you fully against the cost of cancellation by you, medical care and repatriation should you become too ill to continue and must above all cover you against the cost of air evacuation should sickness or injury necessitate such a course of action. You should also note that passenger liability insurance covering vehicles, particularly in third world countries, may be inadequate; it is therefore important that your insurance cover makes sufficient provision for your dependants in the event of an accident. Please note however that we have no control over the availability or standard of medical and repatriation services and facilities in the areas we visit and these do not form any part of our contract with you. Please remember that many of the areas we visit are not as developed as the UK and the availability and standard of such services may well be lower. Please read your policy details carefully and take them with you when you travel. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs. Please bring a copy of your insurance details to the pre departure meeting. In the event that you do not have suitable travel insurance, you will not be allowed to join the trip.

25. Data protection - We shall ensure that appropriate security measures are in place to protect your/the client’s personal data (as defined in the Data Protection Act 1998). When you make a booking, you consent to all the information you provide being passed on to our suppliers, agents, sub-contractors, employees or volunteers whether based inside or outside the European Economic Area for the purposes of our providing you with the Trip.

26. Promotional Materials - By agreeing to these terms and conditions, you/the client consent (unless otherwise stated on your application form) to our staff taking photographs and or video footage of you/the client during the Trip and that these images may be used by us for publicity and training purposes including, but not limited to, in brochures, websites, marketing material and in the media.

27. Your booking is accepted on the understanding that you realise the potential risks and hazards that are involved in adventure travel of this kind, including death, serious injury, loss or damage to property, discomfort and inconvenience. By completing the booking form you confirm that you are aware that standards of health and hygiene vary from country to country, and are seldom as high as they are in the ‘western’ world. The Trip may be physically challenging and include visits to remote areas. You should be aware of the risks to your health from sources such as, but not restricted to, poor local hygiene, high altitude, heat related illnesses, fatigue, physical injury and tropical diseases.

28. The contents of this website are based on knowledge and information available to endeavour overland at the time of writing. No warranty is given for the validity of the information supplied.

29. If you have a complaint - If you have a problem during your Trip, please inform the Trip Leader immediately who will endeavour to put things right. If your complaint is not resolved locally, please follow this up by writing to our Operations Director at our registered office giving your booking reference and all other relevant information and, where possible, evidence. We must receive any such complaint not later than 28 days from the date of completion of your the Trip. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.

30. No servant, agent or authorised representative of Endeavour Overland has authority to commit Endeavour Overland to any liability whatsoever and Endeavour Overland will not be bound by any statement or representation unless it is in writing and signed by both directors of Endeavour Overland Ltd.

31. You have read the information on our website and completely understand the nature of this expedition and what it involves. What is included and not included in the price.

32. Your contract is with Endeavour Overland, a company registered in England and Wales whose registered office is at Oakhill Rise, Roundswell, Barnstaple, Devon EX31 3SE. Company registration number 8135400.
